ABOUT THEME:
“How to Enforce Rights of Junior Advocates to Get Minimum Wages and How to Strive for A Uniform and Equal Fee Structure Code in India”.
ABOUT SPEAKER:
Advocate Haresh A. Raichura, Supreme Court of India, New Delhi:
In 1982, while practicing in District Court Junagadh, he was standing before a cupboard in library and he was reading a Justice P N Bhagwati Judgement. Just then an idea came. If he works hard in district court, his work can benefit only one or two persons. But if he works hard in Supreme Court, it can benefit thousands of litigants. This is how a dream began. In 1990, after 8 years, he was practising in Supreme Court.
ABOUT WEBINAR:
The following sub-topics will be discussed during the webinar namely;
- This is not about asking for subsidies or stipends. This is about examining rights of advocates for equality in matter of receiving of fees irrespective of their standing or experience at Bar, on bases of hours spent on a case.
- This is also about a right to have an enforceable Fee-Structure which can be enforced and recovered from clients on basis of independently verifiable proof of such actual hours spent and work done by advocates in court and how this has now become possible due to certain softwares available in the market.
- This is also about discussing a concept that under Advocates Act, all advocates, other than Senior Advocates, have equal rights to charge and to receive equal fees, through orders of court.
- This is also about discussing rights of junior advocates to be able to get at least some prefixed Minimum Wages.
- The minimum fees per hour may differ in Metro Cities, in other cities and villages and Principal District Judge could have power to decide such minimum fees looking to the economic conditions of a particular district.
