Cabinet Approves Proposal for Promulgation of The Muslim Women (Protection of Rights on Marriage), Second Ordinance, 2019.
In the recent press release, it has been made clear that the Union Cabinet as on 19th of Feb 2019 has approved the suggestion for Promulgation of The Muslim Women (Protection of Rights on Marriage), Second Ordinance, 2019.
This legislative power is granted to the President of Indian under Article 123 of the Indian Constitution. The President of Indian under Article 123 (1) of the Indian Constitution may promulgate any ordinance if both the houses of Parliament are not in session or where the circumstances are such that it becomes necessary for him to act immediately. In order to promulgate any ordinance under Article 123 (1) the assent of the president is necessary.
The proposed Ordinance will protect the rights of married Muslim women and prevent divorce by the practice of instantaneous and irrevocable ‘talaq-e-biddat’ by their husbands. It will discourage the practice of triple talaq i.e. talaq-e-biddat. Promulgation of the proposed Ordinance will provide the rights of subsistence allowance, custody of minor children to victims of triple talaq i.e. talaq-e-biddat.
This first ordinance, i.e., The Muslim Women (Protection of Rights on Marriage), Ordinance, 2019 is still in force.
